That's a strange situation, if I understand you correctly. What I am hearing is that, in some markets, the Z4 M40i will actually be limited to less power than the X3 M40i sold right next to it.
Something doesn't add up here. I can understand how regulatory issues could force different engines or different ECU programming across different markets for a given product. But why would it vary by vehicle in the same market?
