I'd say you're right, but if there is something wrong with the brake system, then I would be more than willing to bet that they would replace the affected parts.
Also wanted to add that this has nothing to do with BMW not wanting to 'back' their products. If the warranty remains as it is now, then they are still standing behind their cars.
Maintenance plan =/= warranty claim.
