I came in with an H1B visa, which is basically employer sponsorship for 3 years and it can be renewed for another 3. After that you are supposed to go where you have come from, unless you manage to convert your status through marriage or winning the Green Card lottery.

If I was laid off and couldn't find another company to sponsor me (nearly impossible shortly after the dot-com bust), I'd have to go back. I certainly wouldn't stay in the US illegally.

Some politicians make it seem like the US has open borders (apart from the actual lack of border at places) and anything goes. It's very hard to get into the US and stay legally and get work authorization. It's also awkward that you can live 6 years on an H1B, pay taxes, not vote, and unlike in the Green Card case, you can't obtain citizenship legally after the 5th year.

having had a lot of experience with this, its waaaay too easy to get things done illegally and incredibly hard to get things done legally...

i would say post 9/11, coming to the us and staying legally is virtually impossible... and for most in the EU; there is very little point to do so as other closer European options exist
